Dear friends,
I am writing this blog post for removing some fears of all our friends those who are working in contractual basis in medical and health department as a MPHA (M). After the Supreme Court decision came out all our friends gone in to dilemma because of rumors of some people wontedly making for their benefit. Actually every people do not know the actual situation happening at Hyderabad. I like to notify some useful topics before you about our job. Our Principal Secretary is very clear about what to do to their subordinates at the time of court decision came out, but our friends changed his brain about the recruitment under the Supreme Court decision by giving different memorandums to him. We are eagerly waiting for the Supreme Court judgment for eight years. At the time court decision was pending all officials and government members saying only word "Subject pending in the Supreme Court, after court decision came out we will take decision about MPHA (M) posts” at finally the decision came out. Originally the Supreme Court supported the high court judgment.
The High Court conclusions/directions:
a) W.P. No. 422 of 2003 and other similar Writ Petition challenging G.O. MS. No. 484 HM&FW (J2) Department, dated 24.12.2002 directly before the High Court are maintainable
b) Prescribing S.S.C. and diploma certificate from recognized institutions by the Government is competent and legal and it did not over ride the statutory rules in G.O. Ms. No. 273, Health, Medical and Family Welfare (H1) Department, dated 24.4.1989 and accordingly the Order of Andhra Pradesh Administrative Tribunal in O.A. No. 6856 of 2002 stands modified warranting no amendments to statutory Rules noted supra,
c)  G.O. Ms. No. 484, dated 24.12.2002 is quashed and W.P. No. 422/2003 and similar writ petitions are allowed,
d) All the interim Orders in the Batch of writ petitions ceased to have any effect. Consequently, we direct the State Government to prepare the select list of candidates in accordance with Rules, who possessed S.S.C. and Diploma certificate either from Government institutions or the four private institutions referred to supra including College of Medical Technology, Ongole, as the cancellation of recognition of the said College was effected on 5.7.2002 which is the subject−matter in separate writ petitions. However, if any selected candidate from this institution is holding certificate issued on 5.7.2002 or thereafter it shall not be given effect to. The candidates so selected shall be issued with the appointment Orders within a period of four weeks from today duly terminating the services of the candidates, who were appointed on the basis of interim Orders and not figuring in the select list prepared under this Order.
As per the above orders only 2324 candidates are eligible for getting the jobs in 2002 notification but in Andhra Pradesh there are 3686 are working on contract basis.  Affecting this judgment nearly 1400 employs are losing their jobs. Here principal secretary think with broad mind and saying that "no terminations are allowed in the contract services, we will accommodate all the employs in service as per the availability of jobs". At this time a request made by G.V.V. Prasad in his letter saying that please accommodate me and my friends also because "we are the candidates in middle of the intermediate candidates, we have greater marks than many of the employs those are not selected and having the intermediate qualification". After this letter all of our officials are get confusion about recruitment.
At this time our Chief Minister Sri. Kiran Kumar announced that the Government ready to give 5444 regular MPHA (M) posts in Medical and Health Department.  Affecting this press release a real twist came front of the government, all employs those who are working as MPHA (M) in medical and health department sister institutions (i.e. RNTCP, APSACS, AYUSH and 104 these are the government sub departments working along with the medical and health department) are also think about the regular posting in the medical and health department and they also made several memorandum to the government to get service benefits. Here one question rose to the government, how many posts he can fill and how many total vacancies are Available in Andhra Pradesh state? At this time director of health gathered information about vacancies and eligible candidates in the state. But this is not giving salvation to the problem because here some employs came with new agenda that is "five years completed candidates". They are asking to the government as per the GO.MS.212.FINANCE & PLANNING (FW.PC.ll) DEPARTMENT. Dt:22.04.1994. Some of the interested employs approached the honorable Andhra Pradesh Administrative Tribunal in this issue as per Haryana High Court orders in they said that “Those who are completed Five Years service are not allowed to termination from service”. This is equality to our GO.MS.212.FINANCE & PLANNING (FW.PC.ll) DEPARTMENT. Dt:22.04.1994. But the problem in this issue is all the employs those who are appointed after the 2002 to till date are appointed under the court interim orders only their appointment Go’s also saying the same issue and all employs joined under a 100/- stamped written document submitted at the time joining in that “our appointments purely temporary, the subject pending in the honorable High/Supreme court after court decision we agreed to obey the government orders what ever it may be”. They do not know what the benefit getting, because government must comply with court orders.
Here problem not only for non selected employee, some other department employs working along with M&H they also requesting for the appointments in 2002 notification upon contract basis because they think that this posts may be converted in to regular posts in feature this is the main problem to the government.  
Here some questions raised before government:
1.  How many employs are totally working on contract basis in M&H department and other related departments?
2.  How many vacancies are available in the M&H department and other related departments?
3.  Is these 5444 posts are only M&H Department is there any other departments posts also mingled init?
4.  Is the government ready to give a special notification for filling the posts in sister departments? What is the number of those vacancies?
5.  Is government giving service weightage   to the other departments employs also? Is they are eligible for this?
6.  Totally how many employs losing their jobs, is government showing any mercy upon the job losing employs?
7.  What is the answer they have if the job losing employs going to court upon Go.224?
8.  What about the total out side candidates i.e. not is service members?
9.  Are vacancies available to give a new notification after filling the posts from various departments?
